Your privacy is important to us and we therefore only process personal data if this is done in a legal and transparent manner. In this privacy and cookie statement, we will explain to you who we are, how we process your personal data, with whom we share it and what rights you have when it comes to the processing of your personal data. Personal data means any information relating to an identified or identifiable natural person. 

You are under no statutory or contractual obligation to provide your personal data to us. However, we may not be able to provide our services to you when you refuse to provide your personal data to us. 

This policy covers the Zoukru mobile application and website (www.zoukru.com). 

01 Who is responsible for the processing of my data?

02 What personal information do you collect from me and for what purpose?
When you download the App, create and verify an account, we collect data from you, such as: 

  • Full name
  • Email
  • Password
  • Phone number 
  • Date of birth
  • Gender

We collect this data in order to provide our services (the legal basis for the processing is contractual necessity).

If you contact us (through the App, our web-contact form, or in any other way), we may receive your name, emailadres, phone number and any personal data included in the message. We process this data, in order to respond to your question or request. Are you using the contact form for the purpose of using our services? Then this data is processed on the legal basis of the conclusion and execution of agreements. In all other cases, your data is collected on the legal basis of your consent. The contact form on the website is secured with reCAPTCHA from Google, to prevent spam. This Google tool collects data, including the IP address. View Google’s privacy statement here

For safety and security reasons, we require you to verify your account. Your phone number and / or e-mailadres is requested as part of the profile verification process. We have a legitimate interest in doing so, because we want to keep our App a safe and secure space and we want to ensure that accounts are not set up fraudulently. Please note that when you set up your account, you are required to provide this information. 

After you have successfully registered an account, you may choose to add additional information about yourself in your personal account (such as education level, sexual preference, marital status, etc.). Make sure to not add any sensitive information if you don’t want to share that information! 

To add pictures or videos, you may allow us to access your camera or photo album. With your permission, we collect your geolocation. The collection of your geographic location may be performed in the background, even when you are not using the App. You can change your settings on your device to revoke the consent given. 

This information will be visible to other users who are presented with your profile. You will be able to review and change this information in your account, at any given time. When you decide to purchase a subscription in the Google Play Store or the Apple Play Store, you share financial information with these platforms. We do not have access to your financial information. 

03 Who provides the information?
In most cases, you provide us directly with your information. However, we may receive information about you from others, when a user reports you due to misconduct. 

04 Social media buttons, third party websites
We have added social media buttons from Facebook to our website. Click here to read Facebook’s privacy policy. If you click on the button, cookies might be placed. This privacy and cookie statement does not apply to third party websites and links. We encourage you to read the privacy statements of these third parties. We cannot guarantee that these third parties will handle your data in a secure manner. 

05 Do you rely on automated decision-making and profiling?
We may use profiling for safety and security reasons. We may close reported accounts. You can always contact us when you don’t agree with such a decision. We will use information you provided, such as your age and dating preferences, and information we collect through the service (such as your location) to show you compatible matches. 

06 How long do you store my information?
We store your personal data for as long as necessary to properly execute and maintain our services and agreements. After that your personal data will be deleted. 

Of course we can keep personal data longer if we are legally obliged to do so and taking into account any limitation periods. We are, for example, bound by the Dutch fiscal retention obligation of 7 years. If we decide to close your account due to misconduct, we may keep your information for a period of one year after closure, due to queries and / or in case of a legal claim. In any case, we may keep (some of) your personal information for (evidence due to) legal claims. 

You can permanently delete your account. Your data will automatically be deleted after you decide to delete your account, within 7 days. 

Please be aware that the information you have shared with other users, can’t be deleted by us. For example, we cannot prevent someone from taking a screenshot from a chat-message. You should therefore always be careful with the information you decide to share with other App users. 

07 Do you collect information about children?
This App is not intended to be used by children. We have an age restriction of 18 years. If you are a parent or legal guardian of a child that created an account by using a false date of birth, please contact us as soon as possible. We will delete the information without undue delay.

08 Is my information given to third parties?
Unlike a lot of other dating apps, we do not sell your personal information to other companies. We do share your information when we are required to do so by legal authorities / regulations, with your consent, when it is necessary to offer our services, to our processors, or when we have a legitimate interest in doing so. 

We have taken the necessary technical and organizational measures to ensure that your data is processed correctly. We have signed data processing agreements with (sub) processors. If possible, we use processors established within the EEA. You should be aware of the fact that your data may be transferred and otherwise processed to a location outside of the EEA. We will only transfer your data to third parties outside of the EEA, if there is an adequate level of protection for the processing of your personal data. These transfers are governed by the so-called “standard contractual clauses”. 

We may share your personal data with it-suppliers and service providers (such as web hosting and our developers team), Twilio (a tool we use to verify your account), mail servers, accountant and accounting software, and payment providers.

You should be aware that the information on your profile, your preferences and any information you choose to share to users, is or can be made accessible to other users, or even people outside the App. We strongly advise you to be careful with the information you share. 

09 Is my information safe?
We cannot guarantee that the way you provide us with your data online is 100% safe, due to the characteristics of the internet. We use safety measures to prevent unauthorized access of your personal data such as secured servers that meet international security standards. These measures are evaluated on a regular basis. You can also take some measures to prevent unauthorized access to your data. Choose a strong password and change it now and then. Don’t give anyone else access to your account. If you become aware of unauthorized access to your account, contact us immediately.

10 Cookies
We set cookies on our website. A cookie is a small piece of data that a website asks your browser to store on your computer or mobile device. The cookie allows the website to “remember” your actions or preferences over time. Some cookies will be deleted after you close your browser, while other cookies remain on your computer or mobile device for the time-period that is set in the cookie.

We make use of Google Analytics to analyze how you use the website. This service is provided by the American company Google and cookies are being set. By doing so, we collect, among other things, your IP address, number of users and sessions, location information, information about your device, browser and session duration. By using Snowplow, the following cookies may be placed for analytical purposes: 

  • _sp_id. Stores user information that is created when a user first visits a site and updated on subsequent visits. It is used to identify users and track the users activity across a domain. This cookie stores a unique identifier for each user, a unique identifier for the user’s current session, the number of visits a user has made to the site, the timestamp of the users first visit, the timestamp of their previous visit and the timestamp of their current visit. Expires after 2 years or cookieLifetime set on tracker initialisation. 
  • _sp_ses: Used to identify if the user is in an active session on a site or if this is a new session for a user (i.e. cookie doesn’t exist or has expired). When using anonymousTracking: { withSessionTracking: true } (2.15.0+) this key will contain a salt value which is used to stitch page views into a session. The value is never sent to the collector. Expires after 30 minutes or sessionCookieTimeout set on tracker initialisation. 

Cookies have their own expiry date. Cookies are therefore automatically deleted. 

Do you want to delete cookies before the expiry date? Most browsers support cookies, but you can set your browser to decline them and you can delete them whenever you like. Usually this can be done through your browser’s ‘preferences’. Please note that if you delete cookies you may lose certain stored information (such as login details) and your user experience could be limited. 

11 What are my rights?
In compliance with the GDPR, you have a number of important rights that you can exercise. Please note however, that in some circumstances we may ask you to provide additional information, such as a copy of your ID or passport, in order to identify you when we have reasonable doubts about the identity of the person who is making the request. 

We shall respond to your request concerning any of the rights mentioned in this section, without undue delay and at least within one month of receipt of the request. We can extend this period by two further months when this is necessary, taking into account the complexity and number of the requests. If we decide to extend the period, we shall inform you about this within one month of receipt of the request.

These are your rights:

  • The right to data portability. This right gives you a higher degree of control over your own personal data. You have the right to receive your personal data in a structured, commonly used, machine-readable and interoperable format so that it can be transmitted to a different party, when technically feasible. 
  • The right of access to your personal data. This enables you to receive a copy of the personal data we hold about you and to verify if we process your personal data in a lawful manner. 
  • The right of rectification and erasure of your personal data. You can request us to rectify your (incorrect) personal data or have it removed.
  • The right to restrict the processing of your personal data. In some cases you have the right to limit the processing of your personal data.
  • The right to object against the processing of your personal data. You can request that we no longer use your personal data. If you object to the use of your personal data for commercial purposes, we will always respect this.
  • The right to withdraw consent at any time. When you have given your permission to process your personal data, you can withdraw your consent whenever you want.  

If you wish to exercise any of these rights, please contact us. We want to remind you that you can adjust your preferences and profile in your account and delete your account at any given time. 

12 What can I do if I have a question or complaint?
If you have any complaints or questions about this privacy statement or the way we process your data, you can contact us by sending an email to info@zoukru.com, or directly via the App. You can file a complaint against us regarding the processing of your personal data with the Dutch Data Protection Authority or possibly another authority in your country, when you live in the EU. If you live outside of the EU, you may file a complaint with your local data protection authority. 

13 Will you change this privacy statement?
We reserve the right to change or modify this privacy and cookie policy at any time. 

The most current version will be posted on the website www.zoukru.com/privacy. In the event of any material changes, we will notify you through email, or you will receive an update in the App.
